Nintendo are greedy hypocrites

Honestly I think claiming videos uploaded directly from the game makes sense because Nintendo's not saying it's copyright infringement, they just put ads on the video because it is their game and you clearly had no creative input on the video if it's uploaded directly from the game (replay editing is very limited and you'd be lucky to get a full reel of decent shots even with the options they give). After all, your account stays in good standing and anyone can still view it, you just can't make money off something you didn't make.

So I think only clips directly uploaded from the game should be automatically claimed, but I'll agree that automatically claiming any and all videos on the entirety of YouTube is ridiculous and a human should decide whether it's necessary to redirect all earnings to Nintendo on a specific video.

I'm not earning money with YouTube anyway so I don't care what claims I get on my vids as long as they don't get removed and don't level my reputation rating.
 
There are people who make a living making reviews on video games, similar to a professional reviewer on, say, movies. Shouldn't they receive a fair share, especially since such reviews are fair use? As for LPers, it's a murkier territory, but I view monetizing videos as a bonus rather than a livelihood. It doesn't take much effort to play a game, although video equipment and actually garnering interest in LPs is pretty difficult.

Getting claimed because of the Crazy 8 logo is still fucking ridiculous, though.

Also related to this, because of Nintendo's YT copywrite things, they could easily censor other people. So let's say someone says something bad about a new game, Nintendo could get away with just taking down the video.
 
The worst they can do is threaten a takedown, since the law is generally on your side. The intimidation is enough, though to scare off reviewers. I haven't seen Nintendo pull off critical videos or attempt legal intimidation, but they can always try that...
